FDAannounced it is taking action to recall the drug Viagra in some of its affected products.
A New Jersey man was arrested Tuesday and charged with conspiracy to distribute Viagra and distributing counterfeit drugs.
Michael Koppel, 33, was arrested in Manhattan in the early hours of a United States District Court in Newark.
Koppel was charged with a misdemeanor drug offense. He faces a maximum penalty of 20 years in prison and a $250,000 fine.
The Viagra-to-Viagra trial began earlier this week. It was reported in the -- a Web site that offers information about the drug's potential side effects.
The FDA has warned consumers about the safety concerns of certain drugs.
Koppel's arrest marks the latest sign of the FDA's investigation into the counterfeit products that have become widely available online.
The company that sells Viagra on the Internet is under a criminal investigation into counterfeit Viagra, which some have found in the U. S.
Koppel's arrest comes two months after U. District Judge William E. Seashane announced that it would require the company to disclose its full list of its counterfeit products.
The FDA said the drug is "an extremely safe drug and is approved by the Food and Drug Administration for treating erectile dysfunction."
Koppel was being investigated by the FDA's Inspector General, who requested a search warrant on Tuesday.
The agency says the product, which is made by Pfizer, was advertised as a "further way to enhance sexual performance," while in reality it is a "pharmaceutical supplement" with "a very similar side effect profile to Viagra."
The product, which is sold in 50 mg, 100 mg, 200 mg, and 300 mg doses, is intended for use on the skin. A "favorable" side effect, which is also called "indication," is often enough to increase sexual satisfaction. The FDA warns consumers that the medication is "not a drug intended to treat erectile dysfunction" and has a "risk of causing permanent or severe erectile dysfunction" in some users.
Koppel, a man of 45, was arrested on Sept. 24 at New York City's airport. His arrest will be made public.
Koppel has denied the FDA's allegations and says the product is "not intended for use in the treatment of erectile dysfunction."
The company did not immediately respond to an order seeking comment.
"We are committed to making sure that consumers are aware of the safety risks associated with the safety of our products and of the products we sell, and that they are informed of the opportunity to make informed decisions regarding their health and well-being," the company said in a statement. "We are pleased that the FDA has acted promptly to investigate this matter."
The FDA has taken action against the company and other online retailers that sell Viagra online.
The FDA said in a statement that "the information provided by the manufacturer does not constitute medical advice and does not substitute for professional medical judgment."
The company will continue to produce its product.
The FDA is expected to issue a warning letter on Tuesday and issue a public comment period after the FDA's investigation is completed.
